CALIFORNIA PROBATE ATTORNEY REFERRAL FEES

Many California attorneys need the help of a California probate attorney. Also, quite often, attorneys licensed in states other than California need probate representation in California. I welcome referrals from attorneys admitted in California and attorneys admitted in other states.

As a licensed attorney in good standing, you can refer matters to me and request a referral fee in compliance with the California State Bar rules.

(See California Rules of Professional Conduct 1.5.1(a) (former Cal Rules of Prof Cond 2–200(A)). Typically, referral fees run 15%-20% of the statutory attorney fee awarded by the court. The court follows California Probate Code Probate § 10810 in setting and ordering the statutory fee the probate attorney and personal representative (i.e. executors, administrators, etc.) can charge for a probate.

In general, the statutory attorney fee is calculated on the appraised value of the entire probate estate as determined by the court appointed probate referee and the personal representative for cash equivalent assets.

The statutory probate attorney fee is calculated as follows:

4% of the first $100,000 of the appraised value of the probate estate;

3% of the next $100,000 of the appraised value of the probate estate;

2% of the next $800,000 of the appraised value of the probate estate;

1% of the next $9,000,000 of the appraised value of the probate estate; and

.5% of the next $15,000,000 of the appraised value of the probate estate.

The court will determine the fee for the amount that is greater than $25,000,000.
